Do I Qualify For An Annulment?

Annulments are different from divorce in that they do exactly what they say: annul a marriage and treat it as though it never existed in the first place. In order for this to be a legal option, your marriage must have begun under circumstances that would have made it illegal in the first place.

You may be able to receive an annulment in situations of:

  • Bigamy: You or the spouse you married were already married to another living person at the time of your marriage
  • Age: If you or the spouse you married is under the age of 18 at the time of your marriage and you do not have written parental consent, your marriage is invalid
  • Kinship: It is illegal to marry someone whom you are related to, including parents, children, siblings, aunts, uncles, nieces, nephews, and first cousins
  • Incapacity: If either spouse was mentally incompetent at the time of the marriage (including senile or insane) the marriage is illegal
  • Fraud: If one of the elements of a marriage contract is concealed at the time of the marriage, an annulment can be obtained on the grounds of fraud
  • Common Law: Missouri does not recognize common law marriages created after 1921, unless they were formed in a state which does acknowledge them
